01 · Who we are and what we offer
UTMTrackly is a service of Playground. di Tano Giuseppe, VAT no. 02610410694, based in Vasto (CH), Italy (“Playground.”, “we”). It lets you create links with UTM parameters, short links and QR codes, organize them in campaigns and folders, and measure their clicks and scans.
In these terms, “Customer” is the company or professional who activates the service, “User” anyone who uses it with an account, “Organization” the Customer’s workspace on the platform and “Content” everything entered into it: links, destinations, campaigns, QR codes and logos.
02 · Plans
- Free: the UTM link builder and static QR codes on the site, free and without an account. It runs in the browser and is offered “as is”.
- Premium: the platform run by us, with the chosen modules (UTMTrackly, Shrtnr, Insights), for a fee. Prices, duration and payment terms are set out in the offer or order accepted by the Customer.
- Enterprise: a licence to install the platform on the Customer’s infrastructure, governed by a dedicated contract which, where it differs, prevails over these terms.
UTMTrackly is designed for professional use: to create an account you must be at least 18 and act on behalf of a company or your own professional activity.
03 · Account and access
- Credentials are personal: keep them safe and choose a strong password.
- The owner and admins of the Organization decide whom to invite and with which role, and are responsible for the use made by the Users they invite.
- Let us know straight away at hello@atipicaplayground.com if you suspect unauthorized access.
04 · Acceptable use
Short links must lead to lawful and honest destinations. You may not use UTMTrackly for:
- phishing, scams or pages that imitate other services to obtain data or payments;
- spreading malware or unwanted software;
- spam or unsolicited messages;
- unlawful content, content that infringes third-party rights (for example trademarks or copyright) or that incites violence or hatred;
- hiding the real destination to get around security filters, including by chaining several short links;
- overloading the service, analysing it automatically or trying to get around its protections.
To protect visitors and the reputation of the domains, we may disable links that break these rules without notice, and suspend the accounts involved. To report a link, write to hello@atipicaplayground.com.
05 · Short links and QR codes
- A short link’s slug is never reassigned, not even after deletion: a printed link will never lead to someone else’s destination.
- The destination of a short link and of a dynamic QR code can be changed at any time; the slug and the domain cannot.
- Dynamic QR codes work as long as the linked short link is active. When the Premium service ends, links and dynamic QR codes stay active for 30 days, then stop redirecting. Static QR codes contain the destination directly and do not depend on the service.
- Short links created with the first version of UTMTrackly (s.utmtrackly.com) are no longer active.
06 · Personal data
What data we process, for how long, with which providers and with which security measures is described in the Privacy policy, which forms part of these terms.
For click data on the Customer’s links, Playground. acts as processor (Art. 28 GDPR) and undertakes to: process it only to provide the service and according to the Customer’s instructions; bind its own providers to the same obligations and inform the Customer before adding new ones; assist the Customer in answering data subjects’ requests and in the event of data breaches; when the service ends, allow the Customer to export the data and then delete it. On request we provide a signed data processing agreement.
07 · Content and intellectual property
Content remains the Customer’s, who guarantees having the right to use it. The Customer grants us only the use needed to provide the service, for example showing a logo inside a QR code.
The software, the UTMTrackly brand and the site’s materials belong to Playground. We grant you a personal, non-exclusive and non-transferable right of use for the duration of the service.
08 · Availability and changes to the service
We do our best to keep the service always available and fast, but there may be interruptions for maintenance, updates or causes beyond our control. Where possible we give notice of planned maintenance.
We may improve and change the service. If a change significantly reduces the features of a paid plan, the Customer may withdraw and obtain a refund of the unused part of the fee.
09 · Liability
To the extent permitted by law, we are not liable for indirect damages such as lost profits or lost opportunities, and our total liability towards the Customer does not exceed the amount paid by the Customer in the previous 12 months. These limitations do not apply in case of wilful misconduct or gross negligence, nor to rights that the law grants consumers on a mandatory basis.
The Customer is responsible for the Content and the destinations of their links, and holds us harmless from third-party claims related to uses prohibited under “Acceptable use”.
10 · Duration and termination
You can stop using the service whenever you like and ask for your account to be closed. Before closing it you can export links and analytics in CSV format from the dashboard. Premium subscriptions follow the duration and renewal rules set out in the offer.
We may suspend or close an account in case of serious breach of these terms or non-payment, after a warning where the situation allows.
11 · Changes to the terms
We may update these terms. We notify Customers of important changes by email or in the dashboard at least 30 days before they take effect. If you do not accept them you may withdraw before that date.
12 · Governing law and jurisdiction
These terms are governed by Italian law. If the Customer is a consumer, the courts of the place where they live have jurisdiction.
For any question about these terms, write to hello@atipicaplayground.com.
